That distinction doesn't really matter. Remembering something related to the skill in question still means that the fact you are remembering is something you learnt in the first place. Plus, if you split those kind of hairs with the lore skill, where does it end? You need to be very careful with this, because otherwise it's not really fair to only apply that sort of house rule to low lore skills; you're giving the players an opportunity to 'lawyer' themselves out of honour loss when using other low skill uses, which removes the benefits of some school techniques. For example, the use of the Commerce skill will result in the loss of some Honour, unless you are a Yoritomo Courtier, or an Ikoma Lion's Shadow using low skills to benefit the Lion Clan.
That said, it is your game, so if you want to apply that, then why not? If you don't think it's fair, then go for it.

Don't get me wrong, i think it's fair. I just don't think it makes sense.

Using a low skill is using a low skill, regardless of whether it's a Lore skill or not, but it's your game. I've had a Unicorn player recently use the Commerce skill to try and obtain something to *ahem* enhance her performance, then wonder why she lost some honour. It's a group new to L5R though, so they're still feeling it out.
