Frog God Games has released a 5e conversion of The Wizard's Amulet. You can download for free at froggodgames.com/5th-editionIt's published using the shield of the OGL. It includes monster stat blocks, and pregens using the character classes that won't be released until the Player's Handbook. Either they're using the playtest data, or they have some sort of access to the PH. Steven Winter is attached to the conversion, which might suggest this is done with the blessing of Wotc, but using the OGL to publish 5e content unchallenged would be an interesting development.

If they're careful not to use the actual text of any of WotC's rules or any of their trademarks this should be legally fine. The ideas behind the rules can't be copyrighted, just the specific words used to express them.
That doesn't mean WotC won't decide to sue them anyway.
If they're publishing OGL, that would mean other companies could use Frog God's expressions of the rules when they want to publish.

Kickstarting thing that hinges on WOTC giving a license and is based on unfinished rules is a bad gamble. The fact that they admit they haven't even really started and don't know what the final page count or content will be are flashing warning signs saying run the fuck away.
I always hope a kickstarter will succeed and deliver, but this is one I will not be touching.
