The failed publisher is still on the hook for refunds since he didn't provide anything. *If* there was a print-and-play only reward, those people might be done, since they've actually been made whole. I'd actually be more worried that the new publisher opened themselves up to problems by stepping in at this point. If this were funded traditionally - the new publisher would have been able to pick up the project and run with it without any complications - seeing as the ones funding it would be owed nothing (which was the risk you take). Kickstarter backers however have a much more transactional relatio ship with the publisher - they are owed rewards. I know it is great PR but what precedent does this set? There could be more scammers in the wings looking to run more kickstarters like this for ostensibly finished products which just need to be printed/produced - spend all the money, and then people will expect that some game company will step in and save them...... It just rustles my jimmies.
